As of 25.5.2018, the General Regulation for Data Protection (EU) 2016/679 is applied, known as GDPR, by which the framework of protection of the subjects of data is reinforced as regards the processing of data of personal character in the European Union. Concerning personal data, Ceres Jewelries complies with GDPR within the scope of the activity and its goal and takes the technical and organizational measures provided for the adequate protection of personal data, as provided in the GDPR and further in the Greek legislation.

These online Terms and Conditions apply to all orders you, the customer, place using our website, www.ceresjewelries.com, which is owned and operated by us, the company “Ceres Jewelries.” Registered office: 88 Agiou Dimitriou Street, 173 41, Agios Dimitrios, Attica, Greece.

1. Acceptance of terms

1.1 While visiting our website, www.ceresjewelries.com, you may be asked to register your personal information. Our company only collects personal information that you knowingly and voluntarily provided. Although each visitor can visit and navigate through www.ceresjewelries.com without giving any personal information, we may collect personal information from you when you register on the website, change your details, request a service, order products, email us, or provide feedback. When you place an order, this data mainly includes your full name, telephone number, billing address, shipping address, email, gender, age, and date of birth. At the same time, optional data such as mobile telephone and fax numbers may be collected. We need to know their shipping address if you ordered products from a third party.

1.2 Any personal information collected by www.ceresjewelries.com is intended to be used exclusively for the fulfillment of our service and the dispatch to you by email of marketing material relating to our products. 1.3 With whom does Ceres Jewelries share your personal information?

Ceres Jewelries does not disclose your personal information to third parties without your permission. However, disclosure may be made if the disclosure is necessary to fulfill a contract to which you are a party, for example, to carriers in connection with the delivery of orders.

However, under certain circumstances and according to the law, it may be necessary to disclose personal data to public authorities or the police. For example, information may be disclosed to the police in case of suspicion of credit card fraud.

In certain instances, Ceres Jewelries transfers your personal data to Ceres Jewelries suppliers who provide services on behalf of Ceres Jewelries, for example, billing, sales, marketing, IT support, advertising, analytics, research, product service support, shipping and purchase order fulfillment, data storage, validation, security, fraud prevention, payment processing, and legal services. These suppliers process personal data on behalf of Ceres Jewelries and by Ceres Jewelries instructions; thus, they cannot process personal data for their own purposes.

1.4 The online shop www.ceresjewelries.com is operated according to Greek legislation and stores your Personal Data safely for as long as you are registered with us. According to the current legislation about Personal Data, our customers have the right to access their Personal Data and object to their data processing according to articles 11 to 13 of law N. 2472/1997. 1.5 What are my rights?. Ceres Jewelries processes automatically and does not create a profile for any natural person who maintains personal data.

You can address us to correct the inaccurate or insufficient data.

The “right to oblivion”.

Provided that we are not obliged by a legal framework to maintain the data that we keep and are related to you, you can ask us to delete them.

You can ask us to transfer your data to another public or private entity.

The right to objection and the limitation of processing.

If you disagree with how we process your personal data, you can request the stop or the limitation of processing.

The right to lift consent.

You have the right to withdraw your consent to processing your data at any time.

Ceres Jewelries will make any endeavor to respond to the request that you will submit without delay and, in any event, within a month from its receipt. The above deadline is extended for two (2) more months, provided this is necessary considering the complexity and the multitude of requests. Ceres Jewelries will inform you of the above time extension within a month from receipt of the request and the reasons for the delay. Suppose you have submitted the request by electronic means. In that case, the update is provided electronically unless you have otherwise asked for it.

Provided that Ceres Jewelries satisfies your request:

  • Limitation of the processing of your data.
  • Refusal of processing your data.
  • For deletion of your data from the organization’s files, provided that they are necessary for the entering into or the continuation and execution of the agreement, then this entails by right either the termination from your part of the corresponding agreement or the non-potential processing of your relevant request.

In any event, Ceres Jewelries has the right to refuse the satisfaction of your request for limitation of the processing or the deletion of your personal data if this processing is necessary for the foundation, exercise, or support of its legal rights or the fulfillment of its obligations.

The above services are provided for free. However, your requests are clearly unfounded, excessive, or reiterated. In that case, Ceres Jewelries may impose a reasonable termination, informing you relatively late or refusing to respond.

1.7 How long are my data preserved?. Ceres Jewelries keeps your personal data only for the period required for processing. However, it has to maintain the personal data for a period defined by the legal and regulatory framework in force.

2. Placing an order

2.1 Only orders placed by adults or persons over 18 will be accepted. By placing an order, you certify that you are an adult according to the laws of your country or state of residence.

2.2 Only orders placed in English or any other language provided by this website will be accepted. By placing an order on this website, the customer states that he has read and understood all the content of these Terms and Conditions.

2.3 We will confirm receipt of your order by emailing the email address you have registered with us through our website.

2.4 Acceptance of your order will occur when, and only when, we send you an email confirming that we have dispatched the items in your order. A contract will be formed between us when we send you an email confirming the shipment of your order. If your order contained several items and the email confirming the shipment does not mention some of them, those items, which have yet to be said, do not form part of that contract. In this case, please send us a new email making a notice about the items not included in your first order, and the same procedure will be followed as above.

2.5 Every effort has been made to ensure that each product’s descriptions, images, and specifications are accurate. However, as the colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will accurately reflect the color of the goods delivered. We may occasionally vary the dimensions, specifications, and quantities of goods displayed on the website without prior notice.

2.6 We may not be able to accept your order due to the following reasons:

a. The product you have ordered is out of stock.

b. There is an error in the product pricing or description.

c. Please meet the eligibility criteria for ordering in these Terms & Conditions.

In any of the above cases (2.6), we will notify you by email within 72 hours of receiving your order.

3. Pricing Policy

3.1 All prices shown on our website are given by default in Euro (€), which will be charged at the current rate.

3.2 Please note that the prices shown on our website do not include shipping costs and any applicable VAT, tax, or duty that may occur during import at the destination country. Shipping costs are calculated during the ordering process and are added to the shopping cart before the order is finalized. Please do not submit a payment if you disagree with the shipping costs. You will know the final price of your order (including VAT and shipping cost) when you have completed all the steps of your order.

3.3 Although we ensure all our prices displayed on our website are accurate, errors may sometimes occur. If we discover an error in the price of an item you ordered, we will email you as soon as possible. Within 48 hours, you can confirm or cancel your order at the correct price. If you do nothing of the above, your order will be canceled.

4. Availability 

4.1 All products shown on www.ceresjewelries.com are subject to availability. Due to the seasonal nature of some of our products, they may only sometimes be available. Our website is updated regularly to ensure that our stock quantities are accurate. However, irregularities in availability and shortages may occur.

4.2. Ceres Jewelries reserves the right to withdraw any product from this website and remove or edit any material or content without prior notice and any liability for any damages from the above actions.

4.3 If an order is placed for a no longer available product, we shall contact you within 72 hours to inform you of the shortage.

5. Cancelling an order 

5.1      If you wish to cancel your order, please contact us by phone on the number shown on your order invoice or by email at: [email protected] stating your order number.

5.2      Cancellation must be received within 24 hours of ordering. If you notify us of a cancellation more than 24 hours after placing the order, we will do our best to accept your request provided we haven’t processed or dispatched your order yet. If we accept your cancellation request, we will notify you by email to the email address you have registered with us.

5.3     It may not always be possible to cancel an order from being dispatched. If your order has already been dispatched, you may return the items to us in accordance with our Returns & Exchanges Policy.

6.  Returns Policy

6.1 Unwanted goods may be returned for an exchange provided that they are returned in their original condition, unused (with their original packaging and with their tags intact) within 14 calendar days following delivery of the goods. We cannot accept any returned item which doesn’t have the original tags attached. For this purpose, please email us at [email protected]. Within 72hours following receipt of your request we will send you instructions on how to return the products to us.

6.2 In case of defective or wrongly delivered items at the fault of Ceres Jewelries., exchanges or full refund of payment shall be issued, upon request, unless the defect or the wrong delivery has taken place or is attributed to the postal carrier’s negligence. If an order is damaged, please do not accept the delivery. If you realize that an order is damaged after opening the parcel, please photograph the damaged items immediately and notify us by phone on the number shown on your order invoice or by email at [email protected] as soon as possible and return the damaged goods to us within 14 days of receiving delivery.

6.3 If you accept delivery of a package from us and (i) the goods are faulty; or (ii) we have sent you an incorrect item, please notify us by phone on the number shown on your order invoice or by email at [email protected] as soon as possible or within 7 days and return the item(s) to us within 14 days of receiving them.  We will exchange the damaged/faulty/incorrect goods without charge to you as soon as possible.

6.4 Please note that the return costs will usually not be reimbursed. Postage or other return costs will be the customer’s responsibility and will be reimbursed by us only in the case of damaged, faulty or incorrectly supplied goods.

6.5 We strongly recommend that you use the returns services provided by us in order to return the goods safely. In the case that the customer wishes to use an alternative shipment service he will have to provide us with a confirmation number, and he will be refunded when and only when the goods have been received by us intact. 

6.6 Until items are returned to us you are responsible for their safety. We recommend that you use postal insurance for any returns, as we do not accept liability for damaged or lost packages during transit back to us. 

6.7 If you would like to discuss the exchange or return of any item or have any further questions about our returns policy, please contact us by phone on the number shown on your order invoice or by email at [email protected], stating your order number.

7.  Payment

7.1   Payment can be made by Visa, MasterCard and Maestro. The payment will be concluded upon ordering the goods to the customer. When your payment is processed, you are redirected to the secure environment of an online payment gateway, which protects your personal information against any leakage or misuse through a secure socket layer (SSL) protocol and Payment Card Industry (PCI) Data security Standard. 

7.2     Ceres Jewelries won’t store sensitive financial information like your credit card details or bank account number nor will keep any records of your financial details. Please note, we cannot guarantee the security of data which you send us by email. Accordingly, please do not send us any payment information using email or any other method. Unless we are fraudulent or negligent we will not be liable to you for any losses caused as a result of unauthorized access to the information you provide us when placing an order.  

7.3     We regret that we cannot accept cheques as payment.  

7.4   Ceres Jewelries has no control over any customs or import / export duties, or any other restrictions and regulations that could be implied in your destination country and for which you will be solely liable. Ceres Jewelries will not be liable under any customs or import or export duties, or any other restrictions and regulations that could be implied at the  country of origin. 

8. Delivery Information

8.1   We currently only ship products to all countries within the E.U. Please note that we cannot make deliveries to P.O. Boxes. 

8.2 All orders are delivered using the shipping methods provided by this website. Your order will be processed within 3 working days. Thereafter you will be notified when your order has been dispatched via e-mail to your registered e-mail address. If an order is placed on national holidays or weekends, it will be processed on the following working day.

8.3 Ceres Jewelries makes every effort to dispatch items on time, however we cannot guarantee specific delivery dates. In any event, the goods will be delivered to the customer no later than 20 working days following the confirmation email we sent you of the order. If the items are not delivered within the specific time period we specify in the email confirming the shipment of your order, please contact us by phone on the number shown on your order invoice or by email at [email protected], stating your order number.

8.4   At our discretion, we may only ship orders to addresses, which match the billing address of the buyer as stated by him on the online form.  

8.5 All orders are sent via tracked delivery and a tracking number will be e-mailed to you upon confirmation.  Some countries’ postal providers do not track international parcels once they have entered their country. We regret the fact that in these cases orders will only be traceable until they leave the country of origin.  

9. Ownership of rights

9.1 Ceres Jewelries retains all ownership rights for all products on this website, including the design, patterns, shapes, and use of materials that constitute the final product. Any unauthorized attempt to copy, reproduce, transmit, publish, display, distribute, or commercially exploit it is strictly prohibited and will be prosecuted by Greek, European, and International laws.

9.2 All content on our website, including text, graphics, logos, button icons, images, and software, is the property of Ceres Jewelries and is protected by Greek, European, and International copyright laws.

9.3 You can use this website’s material data and content only to place orders through www.ceresjewelries.com. Without our prior written permission, you may not otherwise copy, reproduce, transmit, publish, display, distribute, commercially exploit, use, or create derivative works of any material data and content on the website.

9.4 Any other use of our website, indicatively but not solely by posting, distributing, modifying, or removing any of its content, is prohibited without our prior written permission.

9.5 Any unauthorized attempt to defeat or circumvent security features on this website is strictly prohibited and will be prosecuted by Greek, European, and International laws.

9.6 Establishing a link to our home page in a way that implies any form of association, approval, or endorsement of Ceres Jewelries without our written permission is strictly prohibited. You must not establish a link from any website that is not owned or permanently operated by you, nor may you create a link to any part of this website other than the HOME page. Ceres Jewelries reserves the right to withdraw any given linking permission without prior notice.

10. Disclaimer 

10.1 Ceres Jewelries will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or Failure to perform our obligations if that delay or Failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems, postal service performance.

10.2 To the extent permitted by applicable law, we disclaim all warranties, expressed or implied, regarding the accuracy of the information in any location on this website. We shall not be liable to any person for any direct or indirect loss or damage arising from using any of the information on this website.

10.3 In any case, we reserve the right to correct any errors or omissions and to change or update the information contained on this website at any time without any prior notice

11. Limitation of Liability 

11.1 To the maximum extent legally permitted, our maximum liability arising from any order placed on www.ceresjewelries.com for the supply of goods to you will be limited to the retail price of the goods in that order. [note: Under Greek law, excluding liability for malice and gross negligence in advance is not permissible.]

11.2 To the maximum extent legally permitted, Ceres Jewelries is under no circumstances liable for any damage, expense, or compensation arising directly or indirectly from the use or delayed delivery of our products. 11.3 Although we have taken every reasonable measure, we do not guarantee this website is free from viruses or malicious software. To the maximum extent legally permitted, Ceres Jewelries shall not be responsible for any loss from navigating our website or your inability to use it correctly.

12. Applicable Law & Jurisdiction

12.1 The validity and performance of these Terms shall be governed exclusively by Greek laws. The parties submit to the Courts of Athens, Greece’s exclusive jurisdiction, in case of legal proceedings arising from any dispute.

12.2 The above shall not apply to the extent that the laws of the customer’s country of residence provide that another law is applicable or another jurisdiction is competent to resolve any disputes arising from the present agreement. [note: law provisions that apply to a consumer residing outside Greece and are more favorable will apply regardless of the party’s agreement under 12.1.]

13. Email list, newsletter, and promotional emails

13.1 Ceres Jewelries may send newsletters and promotional emails containing news and information about the brand and information about new products, offers/discounts, events, etc.

13.2 We take your privacy seriously, so we will only send you newsletters and promotional emails on two conditions:

  • a. You have subscribed to our promotional email list.
  • b. You are an existing customer who might be interested in receiving information about our new products, events, and offers.

13.3 In case you have chosen to subscribe to our promotional email list, the following terms apply:

  • a. We shall include you in our promotional email list once you have provided a valid email and have pressed the “subscribe” button.
  • b. We shall only collect the email you have provided us to facilitate our communications and no other personal data.
  • c. We shall ask for explicit consent before we collect any other data on you, which may be perceived as personal.
